Raksham is owned, managed, and operated by Yellow Tree ("Organization") ("Raksham", "we", "our", or "us").

By accessing, browsing, registering, or using the Platform, you agree to be legally bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1. About Raksham

Raksham is a technology platform that facilitates:

Animal rescue and welfare initiatives
Rescue reporting and coordination
Volunteer and NGO collaboration
Veterinary support and related services
Pet medicine marketplace
Pet food marketplace
Pet healthcare products
Pet accessories marketplace
Future pet-related products and services

Raksham may modify, expand, suspend, or discontinue any service at its discretion.

2. Eligibility

To use the Platform, you must:

Be at least 18 years of age; or access the Platform under the supervision of a parent or legal guardian.

By using the Platform, you represent and warrant that you have the legal capacity to enter into a binding agreement.

3. User Account

Users may create a single Raksham account that can be used across the website, Android Application, and iOS Application. You agree to:

Provide accurate information
Keep account credentials secure
Maintain updated contact information
Be responsible for all activities under your account

Raksham reserves the right to suspend or terminate accounts found to contain false, misleading, or fraudulent information.

4. Platform Services

Raksham acts as a facilitator for various services and transactions available through the Platform. Certain services may be provided directly by Raksham, while others may involve third-party partners, veterinarians, NGOs, volunteers, pharmacies, logistics providers, or service providers. Availability of services may vary by location.

5. Animal Rescue Services

Raksham provides tools and coordination mechanisms to facilitate animal rescue efforts. Users may:

Report injured animals
Request rescue assistance
Share rescue-related information
Coordinate with volunteers and organizations

Raksham does not guarantee rescue acceptance, rescue completion, response times, availability of volunteers, or veterinary support. Rescue outcomes depend on multiple external factors beyond Raksham's control.

6. Pet Commerce Services

Raksham may offer products including but not limited to:

Veterinary medicines
Prescription medicines
Pet food
Nutritional supplements
Pet accessories
Hygiene products
Healthcare products
Other pet-related products and services

All purchases are subject to product availability. Raksham reserves the right to limit quantities, refuse orders, or discontinue products at any time.

7. Prescription Medicines

Certain products may require a valid veterinary prescription. By purchasing prescription products, you agree that:

Information provided is accurate
Uploaded prescriptions are genuine and valid
The prescription belongs to the pet for whom the medicine is being purchased

Raksham reserves the right to:

Request additional verification
Reject incomplete or invalid prescriptions
Cancel orders requiring regulatory compliance

8. Pricing and Payments

Prices displayed on the Platform are subject to change without prior notice
All prices may include or exclude taxes as specified at checkout
Payments may be processed through third-party payment service providers

Raksham reserves the right to refuse transactions, cancel suspicious orders, or reverse transactions where fraud is suspected.

9. Order Acceptance and Cancellation

An order confirmation does not constitute final acceptance of an order. Raksham reserves the right to cancel orders due to:

Pricing errors
Prescription verification failure
Suspected fraud
Regulatory restrictions
Payment issues

Where applicable, refunds shall be processed according to the Refund, Return & Cancellation Policy.

10. Delivery and Logistics

Delivery timelines displayed on the Platform are estimates and may vary due to weather conditions, logistics constraints, regulatory restrictions, service disruptions, or force majeure events. Raksham is not liable for delays beyond its reasonable control. Further details are governed by the Shipping & Delivery Policy.

11. User Content

Users may upload animal photographs, rescue reports, reviews, feedback, prescriptions, and other content. You represent and warrant that:

You own or have rights to the content
The content does not violate any law
The content does not infringe third-party rights

By submitting content, you grant Raksham a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute such content for Platform operations and promotional purposes.

12. Prohibited Activities

Users shall not:

Submit false rescue reports
Upload fraudulent prescriptions
Misrepresent identity
Engage in harassment or abuse
Use the Platform for unlawful purposes
Attempt unauthorized access to systems
Distribute malware or harmful software
Manipulate reviews or ratings
Violate applicable laws or regulations

Raksham reserves the right to suspend or terminate accounts engaging in prohibited conduct.

13. Intellectual Property

All Platform content including logos, trademarks, designs, software, text, images, graphics, and databases are owned by or licensed to Raksham and protected under applicable intellectual property laws. Users may not copy, modify, distribute, reproduce, or commercially exploit Platform content without prior written permission.

14. Third-Party Services

The Platform may integrate with third-party providers including payment gateways, logistics partners, veterinary partners, NGOs, rescue organizations, and analytics providers. Raksham is not responsible for the actions, services, products, or content of third parties. Use of third-party services may be governed by separate terms and policies.

15. Privacy

Collection and use of personal information are governed by the Raksham Privacy Policy. Users are encouraged to review the Privacy Policy before using the Platform.

16. Disclaimer of Warranties

The Platform and all services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Raksham disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability. Raksham does not warrant uninterrupted or error-free operation of the Platform.

17. Limitation of Liability

To the maximum extent permitted by law, Raksham, its directors, employees, partners, affiliates, and service providers shall not be liable for indirect, consequential, incidental, special damages, loss of profits, loss of data, business interruption, rescue outcomes, veterinary outcomes, or product misuse arising from the use of the Platform. Where liability cannot be excluded under applicable law, Raksham's aggregate liability shall be limited to the amount paid by the user for the relevant transaction giving rise to the claim.

18. Indemnification

You agree to indemnify and hold harmless Raksham, its affiliates, directors, employees, partners, and service providers from any claims, liabilities, damages, losses, costs, or expenses arising from violation of these Terms, violation of applicable laws, misuse of the Platform, user-generated content, or fraudulent activities.

19. Suspension and Termination

Raksham may suspend, restrict, or terminate user access at any time if these Terms are violated, fraudulent activity is detected, regulatory compliance requires such action, or user conduct threatens Platform integrity. Termination does not affect obligations incurred prior to termination.

20. Force Majeure

Raksham shall not be liable for failure or delay in performance resulting from events beyond reasonable control, including natural disasters, floods, earthquakes, epidemics, government actions, power failures, internet outages, strikes, or transportation disruptions.

21. Changes to Terms

Raksham may update these Terms from time to time. Updated Terms will be published on the Platform with a revised "Last Updated" date. Continued use of the Platform following such updates constitutes acceptance of the revised Terms.

22. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, Delhi, India.
